CONDITIONS OF SEALED BID SALE:
1. Sealed Bids will be received at the office of National Land Realty, 1501 N. Pierce Street, Ste. 104, Little Rock, Arkansas 72207 until 2:00 p.m. (CST) Thursday, September 12, 2024. All bids will be opened privately. Please mail your bid to the above address or bids can be faxed to 501-325-0080 or emailed to jstephens@nationalland.com. Please indicate “Evenchik Sealed Bid” on your method of bidding. The successful bidder will be required to close within 30 calendar days from the acceptance date of the executed contract. A bid form is included in this packet. A blank purchase contract will be provided upon request.
2. The acreage is believed to be accurate but is not guaranteed. There is no survey on this property and Seller will not be providing a survey. It is the prospective buyer’s responsibility to verify the accuracy of the acreage.
3. The bids should be made in a lump sum amount and not by the acre.
4. The land will be sold to the highest bidder, but the Seller reserves the right to refuse any and all bids. The Seller has the right to accept any bid that is in the best interest of the Seller.
5. There is no granted legal access. Seller will not provide any guarantee of legal and useable access to the property.
6. Seller will provide title insurance with the exception of legal access in the amount of the agreed sales price.
7. A Warranty Deed will be provided by the Seller. The Seller will pay for one-half (1/2) of the documentary stamps required by Arkansas Law for the closing and recording of the Warranty Deed. The Buyer will be responsible for the remaining one-half (1/2). Buyer and Seller will be responsible for their own closing costs unless agreed upon or specified otherwise.
8. All property taxes will be paid by the Seller up to the day of sale.
9. Upon the completion of the bidding process and the winning bidder has been notified, a purchase contract will be executed by both the Buyer and Seller. The execution of the contract will be the effective date, and the closing shall take place within 30 calendar days. The Seller will be closing with Pro Land Title at 313 S. Main Street, Stuttgart, Arkansas 72160. The Buyer can choose who they wish to conduct their side of closing.
10. After the purchase contract has been executed by both the Buyer and Seller, a deposit in the amount of $2,500 will be deposited with Pro Land Title at 313 S. Main Street, Stuttgart, AR 72160. This deposit shall not be refunded to Buyer unless failure to close is exclusively the fault of Seller or Seller cannot deliver marketable title to the Property as required by this Real Estate Contract.
11. All mineral rights owned by the Seller will convey in a sale. Seller does not warrant or guarantee ownership of any minerals. It is the prospective buyer’s responsibility to verify any mineral ownership.
12. Buyer and Seller acknowledge that the Listing Agency Firm is employed by the Seller. All licensees associated with the Listing Agency Firm represent the Seller. The Listing Agency Firm makes no representations as to the condition of the property. Each prospective Buyer is responsible for verifying all information regarding this property and should be independently verified and investigated by the Buyer or a representative chosen by the Buyer. It is the Buyer’s choice to seek legal counsel or representation by a licensed Arkansas Real Estate Licensee, but it is the Buyer’s sole responsibility to pay for any such services.
