Buildable and non-buildable consider some of the following items (this list is not in any order of importance and is certainly not exhaustive of all items considered in whether a site is buildable or not):<\/p>\n<ul>\n<li>What is the zoning of the site and does zoning permit the use considered?<\/li>\n<li>What is the site size required for the use(s) allowed within the zoning district?<\/li>\n<li>Does the site have access or is it landlocked?<\/li>\n<li>What is the topography? Are there bluff restrictions, slope restrictions, etc.?<\/li>\n<li>Are there <a href=\"https:\/\/nationalland.com\/blog\/an-introduction-to-conservation-easements\/\">easements<\/a> to consider?<\/li>\n<li>Are there right-of-way restrictions for building (example: 75\u2019 from the centerline of the road to the front of the building)?<\/li>\n<li>Are there deed restrictions?<\/li>\n<li>What are setback requirements from <a href=\"https:\/\/nationalland.com\/blog\/understanding-property-boundaries\/\">property boundaries<\/a>, <a href=\"https:\/\/nationalland.com\/blog\/legal-access\/\">easements<\/a>, ROW\u2019s, etc.?<\/li>\n<li>Are there covenants of restriction (as in an HOA)?<\/li>\n<li>Are there any wetlands and what is allowed within that type of wetland (some wetlands can be drained through a wetland mitigation program)?<\/li>\n<li>Can soils support:\n<ul>\n<li>A building<\/li>\n<li>Well<\/li>\n<li>Septic<\/li>\n<li>Road<\/li>\n<\/ul>\n<\/li>\n<li>Are there required distances between each of the above that must be met?<\/li>\n<li>Is the property in a floodplain? If yes, is building allowed and what are the restrictions\/requirements?<\/li>\n<li>Are there water and\/or mineral rights issues\/requirements?<\/li>\n<li>Is property a historic property; does it contain a cemetery, archeological site (example: Native American burial grounds); airport restrictions?<\/li>\n<li>Is property a former or current landfill or is it close in proximity to a current or former landfill?<\/li>\n<li>Are there any encroachments by an adjacent property?<\/li>\n<li>Is the land subject to any <a href=\"https:\/\/nationalland.com\/blog\/want-to-protect-your-farm-or-wetlands\/\">government programs<\/a> (example: CRP, CREP, RIM, etc.)?<\/li>\n<\/ul>\n<p>The list goes on and is the reason a developer works with a surveyor, engineer, planning and zoning, etc.<\/p>\n<p>Many of the items above are in Minnesota\u2019s \u201cVacant Land Disclosure\u201d form. I was on the forms committee when this form was developed, and my land questionnaire questions were incorporated into this form.
