Although the U.S. House of Representatives approved its version of the legislation earlier this year, the Senate has yet to secure the votes needed to pass its own version. The latest extension of the 2018 Farm Bill expired on September 30, leaving Congress to determine the next steps toward a new, comprehensive agricultural policy.

For landowners, the outcome matters as farm Bill programs influence conservation payments, agricultural income support, crop insurance, and the protection of working farmland. The legislation also addresses broader rural development issues that can affect the long-term value and viability of rural communities.

Here is what the Farm Bill does, what is happening in Congress, and which provisions landowners should watch as negotiations continue.

What Is the Farm Bill?

The Farm Bill is the primary federal legislation governing agriculture, conservation, nutrition assistance, and several rural development programs in the United States. Congress typically reauthorizes it every five years, establishing the rules and funding that support agricultural producers, landowners, and rural communities.

Congress enacted the last comprehensive Farm Bill in 2018, and since it expired in 2023, they’ve relied on temporary extensions to keep many programs operating while lawmakers negotiate a replacement.

Although many Farm Bill provisions are designed primarily for farmers and agricultural producers, their effects extend to the people who own the land those businesses depend on. Changes to conservation payments, farm income support, and land protection programs can influence property management decisions, lease negotiations, and long-term ownership strategies.

What Issues Should Landowners Keep an Eye On?

The Farm Bill contains hundreds of provisions, but several areas deserve particular attention from landowners. The final legislation could affect conservation opportunities, the financial health of farm tenants, and decisions about how land is managed or protected.

1. Conservation Reserve Program (CRP)

The Conservation Reserve Program allows eligible landowners and agricultural producers to receive payments for establishing conservation cover on eligible agricultural land. Depending on the enrollment option and property, that cover may include grasses, trees, wetlands, or other conservation practices.

CRP can provide an alternative source of income for qualifying acres that may be less productive for conventional farming, while also supporting soil health, water quality, and wildlife habitat.

Both the House and Senate Farm Bill proposals would reauthorize CRP through 2031, maintaining an enrollment cap of 27 million acres. The Senate proposal would also increase the annual payment limit per landowner from $50,000 to $125,000 and adjust rental-rate calculations to better account for lower-productivity land. If enacted, these proposed changes could be particularly relevant for landowners with substantial CRP acreage or marginal cropland that may be suitable for conservation enrollment.

2. Commodity Reference Prices

Commodity reference prices help determine when eligible agricultural producers can receive payments through programs such as Price Loss Coverage. These programs can provide a financial cushion when market prices fall below established thresholds.

That support matters to landowners who lease farmland to agricultural producers. A tenant’s financial position can influence lease negotiations, the ability to meet rent obligations, and decisions about continuing to farm particular acres.

For landowners, stronger farm income support could help tenants manage periods of weak commodity prices. However, reference prices do not guarantee payments in every situation, and any effect on rental income depends on program eligibility, market conditions, production costs, and the terms of the individual lease.

Landowners negotiating cash rents or reviewing existing lease agreements should consider commodity prices and their tenants’ overall financial outlook alongside any proposed changes to federal support programs.

3. Agricultural Conservation Easement Programs

The Agricultural Conservation Easement Program (ACEP) provides federal assistance to eligible partners, including land trusts and other qualified entities, to help protect agricultural land and wetlands through conservation easements.

For farmland owners, a conservation easement can offer a way to preserve a property’s agricultural character and limit certain future development rights. Depending on the arrangement, an easement may involve compensation for the rights being conveyed, but the terms, eligibility requirements, and financial implications vary.

Both the House and Senate proposals include changes intended to improve the accessibility and administration of agricultural conservation easement programs. These potential reforms are worth watching for landowners who want to preserve farmland for future generations, protect natural resources, or explore alternatives to selling land for development.

4. Data Center Moratoriums and Land Use

The Farm Bill debate also intersects with broader questions about how land is used and protected as demand for data centers and other large-scale infrastructure grows.

Data center development can create new opportunities for landowners whose properties are attractive to developers because of their location, access to power, water availability, and proximity to fiber-optic infrastructure. At the same time, these projects can raise questions about agricultural land conversion, water and electricity demands, local infrastructure, and long-term land-use priorities.

Proposals for data center moratoriums have entered the broader policy conversation, with at least 14 states passing moratoriums to slow or stop data center development entirely until the ecological impact of these developments can be studied further. For landowners, it’s important to distinguish between a policy proposal and an enacted restriction. A proposed moratorium does not automatically prohibit development, and the impact of any policy depends on its final language, jurisdiction, and scope.

What Happens if the Farm Bill Doesn’t Pass?

The House passed its version of the Farm Bill in April 2026, and the Senate Agriculture Committee advanced its version in September. However, committee approval is only one step in the legislative process. The Senate still needs sufficient support to pass its bill, and differences between the chambers must ultimately be resolved.

With the latest extension expiring September 30, the immediate question is how Congress will maintain affected programs while lawmakers continue working toward a longer-term agreement.

As Tammie Sloup reports in FarmWeek, the looming expiration has raised concerns throughout the agricultural space, writing, “If Congress fails to enact a new farm bill or again extend the 2018 legislation by Dec. 31, USDA would be forced to revert to permanent law, triggering commodity support based on outdated 1930s and 1940s price formulas. That could require government purchases or nonrecourse loans far above market value, creating severe market distortions and excessive federal spending. Meanwhile, modern crops such as soybeans, peanuts, sunflowers, and canola have no support under permanent law and would lose their safety net entirely.”

The 2026 Farm Bill remains an important piece of unfinished legislation, but its implications extend well beyond the farm gate. Conservation payments, commodity support programs, crop insurance, agricultural easements, and rural development policies can all influence how landowners manage their properties and plan for the future.

For landowners, understanding the policies that can shape the value, use, and future of their land is paramount in 2026.
